The Department for Transport (DfT) expects courts to be sympathetic to local authorities’ funding constraints under the new code of practice for highways management, Surveyor Transport Network understands.

However a senior figure in the highways sector has warned that the new risk-based approach must not prompt a ‘race to the bottom’ on service levels, due to the greater flexibility it gives councils.
