Residents given option to sell off spaces

 
Residents with private parking spaces in Edinburgh are to be given the option of transferring control to the council, in order to resolve confusion over road ownership.

An increasing number of developments have been created where parking provision forms part of the road, and have been sold along with the property under Road Construction Consent. But owners mistakenly believe they have sole right of use of the parking space and, in many cases, residents have employed private enforcement companies to undertake parking enforcement on their behalf, which ‘would appear to be illegal’.

In response, it is proposed that, in the case of developments within the controlled parking zone, owners of any privately-maintained road be offered the option of handing control to the council. They would then have to buy residential parking permits, which can be used anywhere within their zone.

Owners who decided against council control will not be able to effect any form of control on that road. A spokeswoman for City of Edinburgh Council said: ‘The council as a local authority has a legal duty to manage the use of the road network.

‘There is a clear need to clarify what the legal position is with regard to controlling the parking on both public and private roads in relation to housing developments and allocated parking spaces.

‘This proposal gives owners of private roads the option of transferring the burden of maintaining them to the council, which would save them time and money.’
