Northern Ireland gets tough with fly-tippers

 
New laws targeting fly-tippers have come into force in Northern Ireland this week.
Under provisions to the Waste (Amendment) (Northern Ireland) Order 2007, illegal dumpers face increased fines and prison sentences, and courts will have powers to consider imposing additional financial penalties on those convicted of such offences. These include requiring offenders to pay investigation, enforcement and clean-up costs.
Other provisions, which came into effect this week, include the removal of the defence of acting under employer’s instructions for those charged with waste offences; powers for department enforcements staff to stop vehicles; powers for district councils to require landowners to remove illegally-deposited waste from their properties; and a new, daily fine for failure to obey a direction regarding the management of controlled waste.
Environment minister, Arlene Foster, said: ‘Illegal waste is a major problem. Unauthorised operators – including organised criminal gangs – can generate profits of around £100 per tonne of illegal waste. This leads to a loss of some £24M in taxes each year. In addition, clean-up costs are around £1M per site.’ Other provisions contained in the Order will come into effect at a later stage, including amendments relating to the registration of waste carriers, and the seizure of vehicles involved in waste offences.
