No prosecution for owner of tip breaking permit rules

 
The Environment Agency has admitted the owner of a controversial tip in Wakefield have repeatedly breached the conditions of the site’s permit by not burning off gas emissions, but it has no intention of prosecuting the firm.

Instead, it is to vary the conditions governing the Welbeck site, managed by Welbeck Waste Management.

Area environment manager at the Environment Agency, Gerard Morris, said the breaches of the last 12 months had been ‘thoroughly considered’, but instead of taking legal action there would be a series of permit variations, one of which would be the installation of a gas-utilisation compound, and this which was out for public consultation.

He added: ‘Breaches of a permit condition do not necessarily lead to a prosecution.’
