Mayor burnt by incineration case

 
The West London Waste Authority gained a victory over Ken Livingstone last week after winning the right to incinerate its waste rather than choosing ‘the most energy-efficient ways’ for waste disposal, as the mayor of London had directed.
The High Court quashed the mayor’s two directions relating to waste procurement, issued in December 2006 and January this year, after the authority had previously asked Mr Justice Goldring to intervene. The judge ruled that Livingstone had over-stretched his powers, but the mayor announced he would appeal the decision.
WLWA wants to issue tenders for a contractor that would be able to divert 20% of its biodegradable municipal waste away from the landfill each year.
Its director, Mike Nicholls, had feared the authority would fail to meet its 2010 landfill targets because the mayor had prevented it from undertaking the exercise since 2004 (Surveyor, 8 March).
Livingstone has applied for an order to suspend the decision to quash the directions until an appeal can be heard.
He said the decision sent ‘exactly the wrong negative signals’ to other waste authorities in the capital. ‘We have a strong regional policy supporting recycling and this decision means the amount of London’s rubbish sent to incineration will go up from around 20% to 36%,’ Livingstone added.
‘In addition, the judgement effectively says that quick-fix solutions will be made at the expense of the longer-term needs of the environment.’
WLWA is responsible for waste disposal for the boroughs of Brent, Ealing, Harrow, Hillingdon, Hounslow and Richmond upon Thames.
